Service Agreement

This service agreement (“agreement”) is made between parties Customer (“client”) and DiasporaTV, located at 1 Sherwood Terrace #3D, Yonkers, NY 10704, USA. Both parties shall abide by this agreement. Revisions to this document will be posted on this website.

Service

DiasporaTV offers prepaid subscription-based service that requires a Tornado M50 receiver (“receiver”). Parties agree on the following services that DiasporaTV provides:

  • Albanian Internet Protocol Television (IPTV) channels;
  • Live streaming and channels available in New York (EST) time zone with 24-hour rewinding capability;
  • Video On Demand (VOD) with wide selection of Albanian DVD titles available;
  • Digital Video Recording (DVR) that enables recording favorite shows.
    • Recording can be scheduled or enabled by pressing a single button.
    • This feature is only available if a USB Flash Drive (not included) is connected to the DiasporaTV receiver;
  • Large selection of radio stations;
  • Browsing and sharing of photos, videos, and songs from any computer connected to same network as the receiver;
  • Web surfing, instant messaging, e-mails, weather forecasts, and many other features.

System Requirements

In order to use DiasporaTV service, client must have internet access (cable or DSL) installed already. Minimum internet speed required is 1.2mbps (megabits per second). Because internet connections vary in speed, it is suggested that the client have 1.5mbps or more available for DiasporaTV service to work.

All Tornado M50 receivers can work with DiasporaTV. If client owns such a receiver already, it is most likely configured with another operator. In this case, client must obtain administrative password for the receiver from their previous operator. If the client wishes to obtain the administrative password of the receiver, the client will be able to obtain such password after 1 year of continuous service with DiasporaTV.

Price

DiasporaTV offers 1-, 6- and 12-month prepaid subscription plans at $20 USD per month. The client must posses a Tornado M50 receiver in order to use DiasporaTV service. The receiver costs $90 USD and is a one-time purchase by client at the beginning of service. For service renewal, client must only pay subscription plan (and not receiver). Special offers are valid only for the first year of service. After the first year of service, clients must renew with actual prices.

Replacement receiver costs $130 USD + shipping. Replacement remote control costs $30 USD + shipping.

Shipping

For clients in U.S.A., DiasporaTV will ship receiver with USPS or UPS. For clients in Canada and Europe, DiasporaTV will ship receiver via UPS or FedEx.

The shipping fee is determined at the time the order is made and the fee given to customer. All shipping charges are in addition to DiasporaTV service charges. Upon order completion, client will be given a tracking number to track the order as well as an approximate delivery time as provided by shipping carrier. In any case of returning equipment to DiasporaTV, the client is responsible for all shipping charges.

The following items will be included in the shipping package:

  • One (1) Tornado M50 receiver pre-programmed specifically for client;
  • Power adapter designed to work specifically with Tornado M50 receiver. If you use a different power adapter, you might damage the receiver;
  • Advanced Infrared Remote Control;
  • Network cable (3 feet long) that connects the Tornado M50 receiver to your cable modem or router. If you need a longer cable, you can purchase at any electronics stores such as Staples, BestBuy, Radio Shack, Home Depot, etc. The cable is identified as CAT5 network cable with RJ45 connectors;
  • One (1) RCA cable (3-colored cable) that connects Tornado M50 receiver to television;
  • The following documents:
    • Order Receipt;
    • Installation Manual;
    • Marketing Information.

Payment Methods

Clients can make payments using the following methods. If a payment is received and processed by DiasporaTV before 2PM, the order will ship out the same day. All money orders and checks should be mailed to:

Debit/Credit Card

This payment method is available to clients in U.S.A., Canada, and Europe.

DiasporaTV accepts debit/credit card payments. Client must provide card information to us and the payment will be processed instantly. When paying with a debit/credit card, your verbal approval that you are authorizing the charge will be recorded. If client refuses to be recorded, DiasporaTV requires client to fax debit/credit card and photo identification card. Fax number will be provided upon request. When paying with a debit/credit card, there will be a handling fee of $10 USD for 6-month service plan and $20 USD for 12-month service plan.

Money Order

This payment method is available to clients in U.S.A. and Canada only.

Client can make payment with money order payable to DiasporaTV and mail it to us. As soon as DiasporaTV receives and processes payment, client will be shipped the receiver.

Western Union

This payment method is available to clients in U.S.A., Canada, and Europe.

Client can make Western Union payment for DiasporaTV servces. Western Union Money transfers should be made payable to a DiasporaTV managerial staff member (please contact DiasporaTV for more information). After making the payment, client must contact DiasporaTV and provide the money transfer control number (MTCN). After the payment is processed, DiasporaTV will ship the receiver to client.

MoneyGram

This payment method is available to clients in U.S.A., Canada, and Europe.

DiasporaTV accepts payments through MoneyGram. MoneyGram money transfers should be made payable to a DiasporaTV managerial staff member (please contact DiasporaTV for more information). After making the payment, client must contact DiasporaTV and provide the transfer number.

Check

Client can make payment with a check payable to DiasporaTV and mail it to us. As soon as DiasporaTV receives and processes payment, client will be shipped the receiver.

Refund Policy

Potential client will be thoroughly informed about DiasporaTV service and its contents. After having listened to all the information, potential client decides whether to become an actual DiasporaTV client. All of the information presented to potential client will be mailed in printed format along with the receiver. Information will also be made available on the DiasporaTV website. DiasporaTV is always ready to help its clients with any technical-related difficulties, as outlined in this service agreement.

Payments non-refundable under any circumstances:

  • The DiasporaTV Tornado M50 receiver charge of $90 USD and all replacement purchases are not refundable under any circumstances;
  • Used months in a subscription plan are not refundable.

A refund will be issued only if:

Client does not receive DiasporaTV service for a month at a time due to technical faults on DiasporaTV’s end. In this case, upon request, client can be refunded unused subscription months but not the used months.

A refund will not be issued if:

Client has DiasporaTV service and: service quality is up to par, there are no service interruptions over 30 days at a time, DiasporaTV staff is ready and willing to assist in troubleshooting technical problems, then the client will not be granted a refund.

Cancellation Policy

Client has right to cancel service if:

  • Client does not receive service from DiasporaTV for a month. In this case, client has the right to cancel service and all of unused months in the subscription plan will be credited back to client, including the month that service was not used.
  • Client does not receive proper assistance from DiasporaTV technicians as outlined in this service agreement. In this case, client should ask to speak to an available manager at DiasporaTV; if the client is still unsatisfied after all support is provided as per this document, the request to cancel service will be approved. Upon such approval, the client will be credited back the unused subscription months but not other costs that were added to original order (such as shipping, receiver, etc.).
  • Subscription plan expires and client chooses not to renew. Unless client calls to renew subscription, the service will stop at expiration date. Client can hold on to the DiasporaTV receiver and whenever client decides to continue service, DiasporaTV will enable service on the same receiver that was used before.

Client does not have right to cancel if:

  • Client initiates a charge-back (dispute with their card bank) despite all of DiasporaTV’s adherence to this service agreement.
  • Client has DiasporaTV service or any devices from DiasporaTV. Client cannot cancel service with the reasons similar to “I do not like the TV stations or the content offered in the DiasporaTV service”. This is because:
    • DiasporaTV has no control over the content of TV stations broadcasted in its package;
    • Each client is thoroughly informed about the DiasporaTV channels and type of content prior to ordering service from DiasporaTV. Because the client chooses to order DiasporaTV service after being informed and fully aware of our TV stations and content, client cannot cancel service.

Garancioni

Receiver is covered by 1 year warranty only for software-related problems. All other possible problems are not covered by warranty. Accessories (remote control, power adapter, cables, etc.) are not covered by warranty. Clients pay for all shipping expenses for receivers that are sent for inspection under warranty.

In the shipping package, client can find the user manual that explains how to install the receiver. If client has trouble installing the receiver, it is best to visit www.DiasporaTV.com and click on the “Support” link. If client cannot find help on our support site, client should call DiasporaTV to get assistance from a DiasporaTV technician. All client requests that are not present on our website support will be added by our technicians.
